These Terms of Use ("Terms") set forth the terms and conditions according to which you ("you" or "user") may use the website infostreamhub.com (the "Site") and the content provided therein, developed and operated by M.D. PRIMIS TECHNOLOGIES LTD ("Company," "we," or "us"). These Terms constitute a legally binding agreement between you and us.

  • The appearance of any advertisement, sponsored link, or suggested content does not constitute our endorsement or recommendation.
  • We have no obligation to monitor the Site, Site Content, or Third-Party Content for accuracy, safety, legality, or compliance. We may, but are not required to, remove or modify any content at our sole discretion.

4. Intellectual Property and Restrictions of Use

4.1. Ownership: As between you and the Company, all rights, title, and interest in and to the Site and all original content (excluding Third-Party Content), trademarks, copyrights, and trade secrets related thereto shall vest solely with M. D. TECHNOLOGIES LTD. These Terms grant you only a limited, non-exclusive, non-transferable right to use the Site in accordance with these Terms.

4.2. If you submit or upload any content to the Site, you grant us a worldwide, royalty-free, irrevocable, sublicensable license to use, reproduce, display, and distribute such content for the operation, improvement, or promotion of the Site.

4.3. Restrictions: You agree not to, directly or indirectly: (a) copy, transmit, modify, decompile, reverse engineer, or attempt to derive the source code of the Site; (b) use the Site Content in any fraudulent, unlawful, or unauthorized commercial manner; or (c) interfere with the security or operation of the Site.

4.4. No Automated Access: You agree not to use, launch, or permit any automated system, including without limitation robots, spiders, offline readers, crawlers, scripts, or data mining tools, to access, copy, index, scrape, or extract any portion of the Site or Site Content. Any such use is strictly prohibited and may result in immediate suspension of access, legal action, and the pursuit of any remedy available under applicable law. You further agree not to bypass or interfere with any measures used to prevent or restrict access to the Site.

4.5. We reserve the right to take any action we deem appropriate, including blocking access to the Site or pursuing legal remedies, to enforce these restrictions.

5. Copyright Policy (DMCA)

The Company respects the intellectual property rights of others. Our copyright policy incorporates the Digital Millennium Copyright Act of 1998 ("DMCA").

5.1. Submission of DMCA Notice: If you believe any content on the Site infringes your copyright, please report the alleged infringement by submitting a DMCA notice to our Designated Agent via email: contact@infostreamhub.com.

5.2. Notice Requirements: The DMCA Notice must include the required elements set forth in 17 U.S.C. ยง 512(c)(3), including identification of the copyrighted work, the location of the infringing material (URL), and a statement under penalty of perjury that the information is accurate and that you are authorized to act on behalf of the copyright owner.

5.3. Submission of a counter-notice does not obligate us to restore the removed content. We may, in our discretion, choose not to reinstate any material.

6. Disclaimers and Limitation of Liability

6.1. DISCLAIMER OF WARRANTIES:

THE SITE AND SITE CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL M.D. PRIMIS TECHNOLOGIES LTD BE LIABLE FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, DIRECT, INDIRECT, PUNITIVE, OR TORT DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, DATA, OR BUSINESS) ARISING OUT OF OR IN CONNECTION WITH THE USE OF, OR INABILITY TO USE, THE SITE, REGARDLESS OF THE LEGAL THEORY (CONTRACT, NEGLIGENCE, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS OR LIMITATIONS OF LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW. FOR THE AVOIDANCE OF DOUBT, THE FOREGOING EXCLUSIONS APPLY TO ALL THEORIES OF LIABILITY AND COVER, WITHOUT LIMITATION, ANY LOSS ARISING FROM RELIANCE ON SITE CONTENT, ERRORS OR OMISSIONS IN SITE CONTENT, UNAVAILABILITY OF THE SITE, OR ANY ACTIONS TAKEN IN CONNECTION WITH ADVERTISEMENTS, SPONSORED LINKS, OR THIRD-PARTY SERVICES.

6.4. To the maximum extent permitted by law, in no event shall the Company's total aggregate liability for any and all claims arising out of or relating to the Site or these Terms exceed one hundred U.S. dollars (USD $100).

7. Governing Law and Jurisdiction

7.1. These Terms and any dispute or claim arising out of or in connection with these Terms or your use of the Site shall be governed by and construed in accordance with the laws of the State of Israel, without giving effect to any conflict of laws principles. You hereby irrevocably and unconditionally submit to the exclusive jurisdiction of the competent courts in Tel Aviv, Israel, in respect of any matter arising out of or in connection with these Terms.

7.2. Before initiating any legal proceedings, you agree to first attempt to resolve any dispute with us informally by contacting us at the email address below. We will attempt to resolve the dispute in good faith within thirty (30) days.

8.1. Privacy: Our practices regarding the data we collect when you access or browse the Site are detailed in our Privacy Policy, incorporated herein by reference.

8.5. Assignment: We may assign or transfer our rights and obligations under these Terms without restriction. You may not assign any of your rights or obligations under these Terms without our prior written consent.
